NOTICE: At the regular monthly meeting on November 9th, 2011, the Board of the Timber Lakes Property Owners Association approved by a vote of 4 to 3, an increase in the annual assessment for 2012. The assessment will be $650.00, an increase of approximately 6% over the 2011 level. This increase was approved to help cover costs associated with the Blue Spruce Project and the likely construction of a new fire exit road into the national forest area from the upper mountain. The fire exit road will vastly improve safety for the entire community and will cost approximately $187,000.00.

Our new recycling shed is now fully operational. We encourage all Timebr Lakes owners to participate in our commumity effort to recycle our trash.

On behalf of all owners, I would like to thank Dave Read for the many hours of hard work he put into designing and building the recycling structure. We also thank those who assisted him in any way. Way to go Dave!

All West Disruption Tonight

There will no telephone, internet or television service from All West Communications to Timber Lakes tonight (September 13, 2001), beginning at approximately 11:00 pm.

All West has advised us that they need to perform some repairs on their fiber optic line between Woodland and Timber Lakes. These repairs require them to shut down their services to Timber Lakes tonight. They will shut down telephone, internet and television services at approximately 11:00 pm. They anticipate restoring services by approximately 3:00 am tomorrow morning.

If you have questions, or problems after service is restored, you can contact All West at 866.255.9378 or 611 (if you are calling within Timber Lakes).

New Board Members

At our annual meeting this morning, owners re-elected Mike Durr to the Board and elected Theresa Gubler & Rex Gale to new three-year terms. Congratulations to these Board Members.

For your information, approximately 70% of the owners who responded are in favor of allowing lot combinations and charging some kind of fee for the combination.

Thanks to everyone who voted by proxy or in person. Thanks to the approximately 130 owners who make the time to attend the annual meeting. Thanks to our Timber Lakes employees who helped make the meeting happen: Martha and Belinda.

Annual Meeting

We are holding our Annual Meeting this Saturday, July 9, from 10:00 am until noon at the Wasatch County Senior Center located at 465 East 1200 South in Heber City, Utah. We invite all Timber Lakes owners to attend and participate.

As a reminder, please be careful in Timber Lakes. Several black bears are roaming around the development and are coming up onto porches and decks. Bears can be very dangerous. Please report all bear sightings to security as soon as possible. If you have not read our recent bear alert, please do so now.

Bear Sightings

With the snow melted and the warmer weather, we have had several bear sightings reported in the last week. Bears have been seen on Aspen, Greenbriar, Columbine, Eagle and Fawn. In at least one instance, two bears were pawing at the front door of a cabin. These are black bears and they can be dangerous. Please be careful and use some common sense. Do not store food or trash outside your cabin. Keep your grill cleaned and stored securely. Do not let children run around unsupervised. You cannot generally outrun or outclimb a black bear. Consider obtaining and learning how to use bear spray. Report bear sightings to Security at 435.785.8764.

Board Change

On behalf of the Board of Directors, I am announcing a change in our membership. Ole Smith has resigned from the Board, due to a change in responsibilities at his employment. Ole has served on the Board for more than three years and was instrumental in overseeing the building of our vehicle storage building. Ole’s expertise and connections saved the Association thousands of dollars. He put in a lot of time and effort and we wish him well with his new responsibilities.

Our governing documents require that the Board appoint an owner to complete the unexpired term of someone who resigns from the Board. Accordingly, after careful deliberation, the Board has appointed Gordon Huetter to complete Ole’s term, which ends in July 2013.

Gordon is a long-time property owner who has attended most of the board meetings for many years. He also serves as a director on an HOA board in Moab and has valuable experience pertaining to many of our current issues.

We welcome Gordon to the Board and look forward to working with him.

April Board Meeting

Our regular meeting of the Board of Directors of the Timber Lakes Property Owners Association will be held at 7:00 p.m. on Wednesday, April 13 , 2011, at the Wasatch County Senior Citizen’s Center, located at 465 East 1200 South in Heber City, Utah. Owners are welcome to attend and encouraged to participate.

We apologize for the problems with scheduling a meeting in the Salt Lake Valley. This is not intentional. We have had our meeting room scheduled out from under us and have only recently learned that the Whitmore Library has changed their scheduling rules without notifying us. We checked all the other libraries in the Salt Lake Valley and none are available for the April Meeting. We are attempting to rectify this, but in the mean time, we have to hold the April Meeting in Heber City.

The Association’s Annual Meeting will be held on Saturday, July 9, 2011 at the Wastach County Senior Citizens Center in Heber City, Utah, at 10:00 am. There are three open positions for the Board of Directors that need to be filled by election. We encourage owners to consider running for the Board. Proper operation of Timber Lakes and appropriate protection for its assets requires the involvement of the owners. Please consider giving something back to our mountain community and run for the Board. We are trying to get a winter edition of the Timber Lakes Newsletter out ASAP! We need your help: in addition to articles from the board members, we are trying to collect “Slice-of-life” and personal input from our community – making the newsletter more personable, entertaining and even more informative. Communication is key!

Please send your stories about living in Timber Lakes, fundraiser info, charitable interests, school-related info, social group info, etc. Photographs are also greatly needed!

Please e-mail your info/ideas and high-res digital pictures, this week if you can, to Theresa.gubler@gmail.com. While we cannot promise that all info and pictures will be included, we will do our best.

Again, our goal with expanding the newsletter content is to try and get more people involved and create an even greater sense of community here in Timber Lakes.

2011 Annual Assessment

At the meeting of the Board of Directors held on November 10, 2010, the Board voted to maintain the same annual assessment amount in 2011 that we have had in 2010. There will be no increase in the assessment amount for the 2011 fiscal year. In January, you will receive an invoice for your assessment from the Association for $613 for each lot you own. The invoice is payable upon receipt and is late after March 31, 2011. Late payments will also incur late fees and interest charges. The assessment is still due, even if you do not receive an invoice. If you do not receive your invoice by January 15, please call the office at 435.785.8762.

October Board Meeting

Dispute and Allegation

Dear Timber Lakes Property Owners:

It is with regret that my first posting to you as your new President involves a dispute with an adjacent property owner. An allegation has just been made that your right to use Spring Creek Drive and Blue Spruce from the end of Lake Pines Drive near the beaver pond to access common area and lots on the upper mountain is in question. The Association considers this claim to be spurious, but is not lightly reacting to the allegation.

In summary, the owner of that property has demanded immediate payment in the amount of $250,000, or a trade of some of our common area and a 99-year lease on other property owned by Timber Lakes. This common area addition would enable him to develop an 18-acre parcel bordering Timber Lakes, which he already owns. He has indicated this would be a commercial development. Should we agree to these demands, only then would he acknowledge the rights of TLPOA and its members to those roads.

I have asked our outside counsel to handle this issue. I plan to devote most, if not all, of the September monthly meeting in Heber City to this situation. I have no intention of making any decisions regarding this matter behind closed doors without owner involvement and support. You will be kept informed. That said, I would ask that you try to attend the next meeting, on September 8, 2010 at 7:00 p.m. As you know, our By-laws require a 2/3 vote of the membership to trade title on common area. I am also not going to write a check for $250,000, or any amount for that matter, without a clear mandate from the membership.

There is one other part of the claim of which you should be aware. This individual has also postulated that years of grading and plowing Blue Spruce has caused silts to alter the size of the beaver pond that he owns. He has asked us to restore that area. I have asked the Association’s General Liability Insurer to investigate and defend that specific claim. I do not want our membership bearing the costs for others’ actions. Anyway, I felt it important that you be informed. We should have a better understanding of all positions and facts by the time we meet in September.

If you have any information or facts that your Association should be made aware of, please provide it to us as soon as possible.

Entrance Beautification Work

We will continue to work on the Entrance Beautification Project next week. Please bring gardening tools, chainsaws, trailers and good cheer. We are removing dead trees, noxious weeds, and preparing the red rock gardens for planting of wild flower and native plants. If you are interested, please meet in front of the Timber Lakes office at 6:30 pm on Tuesday, August 3, 2010. We will also be working Wednesday evening, August 4th from 6:30-8:30 Jeff’s group wants to continue the project and is asking for help from owners who can volunteer a little time. Please contact Jeff with the time and date you are available to assist on the project.

Also, if you are putting hours in to remove timber and brush around your lot, be sure to track your time and complete the form included in the last issue of the Timber Lakes Times to submit for Matching Funds.

Entrance Beautification Project

Jeff Meierhofer, Chairman of our volunteer Entrance Beautification Committee, reported that 11 people helped on Saturday to remove dead timber and weeds from Lake Creek Road to the Timber Lakes entrance gate. Thanks to those who showed up to help out. They made progress, and although there is more work to be done, it was a good beginning to the Entrance Beautifcation Project. The group has a total of 30 hours work that will be turned into the State for matching funds (fire) to determine if the State will help us with additional funding for common area brush removal.

We will continue to collect down and dead wood, remove noxious weeds, and prepare the red rock gardens for planting of wild flower andnative plants. Jeff’s group wants to continue the project and is asking for help from owners who can volunteer a little time. Please contact Jeff with the time and date you are available to assist on the project.
