Community cleanup and lunch

We are holding a community cleanup for Timber Lakes common area around the office, dumpsters and gatehouse, as well as portions of Lake Pines Drive and Lake Creek Road. We will meet at the office at 8:00 am on Saturday, August 28 and return to the area about 11:00 am for a provided lunch. We will have trash bags and safety vests; we just need you and your pair of gloves. You will also need your appetite at 11:00 am.

If you missed out on helping Jeff Meierhofer and his crew, come help us clean up the trash that magically accumulates around the entrance.

All owners and guests are invited and we hope to see you there. Call 435.785.8278 with any questions. Come help us enhance the entrance to our community.

Dispute and Allegation

Dear Timber Lakes Property Owners:

It is with regret that my first posting to you as your new President involves a dispute with an adjacent property owner. An allegation has just been made that your right to use Spring Creek Drive and Blue Spruce from the end of Lake Pines Drive near the beaver pond to access common area and lots on the upper mountain is in question. The Association considers this claim to be spurious, but is not lightly reacting to the allegation.

In summary, the owner of that property has demanded immediate payment in the amount of $250,000, or a trade of some of our common area and a 99-year lease on other property owned by Timber Lakes. This common area addition would enable him to develop an 18-acre parcel bordering Timber Lakes, which he already owns. He has indicated this would be a commercial development. Should we agree to these demands, only then would he acknowledge the rights of TLPOA and its members to those roads.

I have asked our outside counsel to handle this issue. I plan to devote most, if not all, of the September monthly meeting in Heber City to this situation. I have no intention of making any decisions regarding this matter behind closed doors without owner involvement and support. You will be kept informed. That said, I would ask that you try to attend the next meeting, on September 8, 2010 at 7:00 p.m. As you know, our By-laws require a 2/3 vote of the membership to trade title on common area. I am also not going to write a check for $250,000, or any amount for that matter, without a clear mandate from the membership.

There is one other part of the claim of which you should be aware. This individual has also postulated that years of grading and plowing Blue Spruce has caused silts to alter the size of the beaver pond that he owns. He has asked us to restore that area. I have asked the Association’s General Liability Insurer to investigate and defend that specific claim. I do not want our membership bearing the costs for others’ actions. Anyway, I felt it important that you be informed. We should have a better understanding of all positions and facts by the time we meet in September.

If you have any information or facts that your Association should be made aware of, please provide it to us as soon as possible.

Important Gate Remote Notice

Notice to lot owners who possess gate remotes to Timber Lakes.

We are asking all owners that have remote gate openers to take a few minutes to stop by the Timber Lakes gate security building or Timber Lakes office and give us the remote number of your remote or remotes (each remote has a different number).  We will collect the codes for several months and then we will erase all the codes out of the current system and add back into the system the codes that we have been given by owners.  Those of you that have not given us your specific codes, will no longer be able to use your remote to open the Timber Lakes gate.  We can add your code anytime – but just remember,  if you have not given us your unique code(s) in advance, we cannot add your remote(s) back into the system. This means your remote(s) will not work until we have your specific code from the back of your remote.

If you cannot stop at one of the two areas that can collect  your remote information,  you are welcome to fax or email it to us and we will enter it into the system.

Click here to download a form which you can complete and either fax or email to our office.

If the code has worn off the back of your remote, you can open the remote by removing the screw on top. The code is on the white tag attached to the inside back cover.  Copy that number and send it with the above requested info. Remember, if you copy the code down wrong, it will not let you open the gate.

We will collect the codes for about two months. On November 1, 2010, all remote numbers will be erased and only the numbers you have supplied to us will be entered into the system. If you have not supplied us with your code, your remote will not work after November 1, 2010.
